Man awarded €25,000 after suffering injuries at work

Man awarded €25,000 in damages following an occupational accident at the Malta Freeport in 2002.

Magistrate Lorraine Schembri Orland awarded Edward Chilton the sum of €25,000 in damages following an occupational accident in 2002.

The man, 54,  from had was carrying out works on machinery known as Fantuzzi 55 at the Malta Freeport in B'bugia when he fell from a height of two meters.

While the employers did not contest the liability for damages, they argued that his claim was out of proportion. Attempts to reach as an out of court settlement were rebuked by Chilton.

In 2005 Chilton, who works as an electrician, had filed for damages against the company General Repairs Ltd three years after the incident.

Chilton claimed that following the incident he had lost his job with General Repairs Ltd, and subsequently was employed as auto electrician with Bonnici Brothers Ltd.

However, due to the incident he suffered partial loss of hearing and cannot carry heavy equipment. Following the incident, the company sent people to help him when his duty entailed the carrying of heavy items.

Court experts had filed reports that due to the incident the man had suffered 9% permanent disability.

The court heard all the submissions and awarded him €25,195.14.
