Court dismisses challenge against judge

Court dismisses applicant's challenge because he had not exhausted ordinary remedies.

The Court of Criminal Appeal dismissed the challenge filed by Morgan Ehi Egbomon against Judge Abigail Lofaro.

The 50-year-old Nigerian claimed the First Hall of the Civil Court in its Constitutional Jurisdiction had breached his fundamental rights to a fair trial and presumption of innocence. 

The Attorney General argued the applicant had not exhausted ordinary remedies. Moreover, proceedings before the Criminal Court had not commenced so the request was premature.

Judge Lofaro had decided the man could only file a constitutional case after exhausting all other remedies.

In its decision the Court of Criminal Appeal maintained that the First Hall had not decided the merits of the application and there were no grounds for the Nigerian's challenge to Judge Lofaro. The court dismissed his application.

Egbomon is facing charges of money laundering.
