Polidano appeals €100,000 court fine
Charles Polidano appeals environmental fine stating site was not his.
Charles Polidano appealed from the €100,000 fine he received last week on alleged destruction of trees and rubble walls. Claiming he was being targeted, he said the property where this took place was not his, having been transferred back in 2006.
The appeal noted how the most basic rules of criminal procedures were not observed. "The prosecution failed to present names of those present on site when the alleged destruction took place. No witnesses confirmed whom they worked for. Moreover, they claimed they never saw Polidano on site, nor had they ever spoken to him" defence lawyer Michael Sciriha said.
Defence said that the accused had no obligation to prove anything as the burden of proof lay on the prosecution. Nonetheless, documentation was presented showing the site was not Polidano's.
Polidano's lawyer also noted how the court embodied its reasoning behind the conviction in mere four lines.
Michael and Lucio Sciriha signed the appeal.
