Polish company ordered to refund €42,400

Court orders a polish company to refund payment on a purchase agreement after company failed to dispatch the merchandise.

Polish national and owner of trading company ABC Trade, Wieslawa Milewska was ordered by the civil court to pay the amount of €42,400 after failing to honour a commercial agreement with a local company Worldwide Company Ltd.

On 4 February 2011 Worldwide Company Ltd purchased a 20-foot container of skimmed milk powder from the polish agent. On 15 February the company paid for the purchase by bank transfer however the container was never dispatched. Worldwide Company Ltd demanded an explanation and on 30 August, Polish lawyers intervened over the purchase contract but neither the milk nor the payment ever reached the Maltese company.

Mr Justice Mark Chetcuti ordered Wieslawa Milewska, as owner of ABC Trade in Poland to refund the €42,400 to Worldwide Company Ltd. The court also ordered the polish national to pay the accumulated interest and court expenses related to the civil suit.
