Farrugia Sacco files second Constitutional case

Judge Lino Farrugia Sacco files another constitutional case claiming his rights were violated as the CAJ informs the Speaker that the reasons for the Judge's impeachment are still valid.

Mr Justice Lino Farrugia Sacco has tabled another Constitutional Case claiming that his right to a fair trial was violated when the Commission for the Administration of Justice called him to testify for the second time over the same investigation.

The judge explained that after the first impeachment motion was declared null, another motion was put forward and the Commission again called him to give his version of events.

Moreover, his case was prejudiced further by comments passed by Opposition Leader Simon Busuttil, in his regard, he claimed.

The Clerk of the House of Representatives, Raymond Scicluna took the witness stand saying that the ruling given by the Speaker of the House Anglu Farrugia, was based on the advice of Professor Ian Refalo.

Scicluna explained that correspondence was exchanged between the Speaker and Farrugia Sacco's lawyers. 

Next of the witness stand was Deborah Farrugia, from the Commission for the Administration of Justice.

She said that all replies sent by the Commission to the Speaker, were agreed upon by all members of the CAJ. One of these replies was a statement by the CAJ informing the Speaker that the reasons for the Judge's impeachment were still valid for the second motion.

The case continues on 11April.
