Daryl Luke Borg files constitutional case requesting authenticated copy of incident report to be submitted as evidence

Daryl Luke Borg, wrongfully charged with armed robbery in 2013 has filed an application to the Constitutional Court, requesting it order the Commissioner of Police to exhibit an authenticated copy of the incident report, claiming that it is an important piece of evidence.

The damning report, which was finalised more than 18 months after the inquiry was concluded, according to media reports, recommends that disciplinary measures be taken against two members the CID department who had arraigned Borg, as well as highlighting a severe lack of miscommunication between investigators.

In August 2013, Birkirkara resident Daryl Luke Borg, had been charged with carrying out an armed robbery at a convenience store in Birkirkara. Borg had been arraigned on August 7, being held under preventive custody for two days in spite of CCTV footage showing a considerable difference between Borg’s  height and that of the actual robber.

Five days after the hold-up, Roderick Grech had admitted to carrying out the armed robbery. Borg was subsequently released on bail before a magistrate cleared him of all charges on August 12th this year.
