AG recommends Presidential pardon to be upheld in jailed mother case

According to TVM news, the Attorney General has recommended that a presidential pardon requested by a 57-year-old mother is accepted.

The mother, by profession a teacher, was jailed after her estranged husband demanded that police charge the woman with withholding access to her then 17-year-old son.

However, both mother and son said the son, today 18, did not wish to meet his father and she could not force him to.

The mother has now formally written to President George Abela - through her lawyer Leonard Caruana - asking him to issue a pardon as allowed in the Constitution.

The President's Office confirmed receipt of the letter and forwarded it to Justice Minister Chris Said "for his consideration and advice".

Now that the Attorney General has recommended that the mother's request be upheld, everything now depends on the Justice Minister and the Cabinet where the request will be discussed.

Meanwhile, The Sunday Times this morning reported that the Public Service Commission will give the woman the opportunity to make her case and keep in mind the particular services. This to give the woman the opportunity not to lose her job as a teacher in a state school.

Does the President need permission from Minister Said to pardon this woman? Isn't the President aware of what is going on? And isn't the President the one to pardon this woman? Maybe Chris Said should make the incompetent courts apologize publicly to the People of Mellieha for the libelous demeaning and disgraceful remark made by a certain magistrate while sitting on the bench during a trial.

According to the Malta Today the President's son is the lawyer of husband of the jailed 57 year old mother in question. May I ask whether such a situation puts the President in a conflict of interest?

Atrocious judicial/courts situation. Government was wrong, like in so many other cases, to award remuneration increases prior to performance being graded as at least acceptable. But the PN's interest (read electioneering) has always sidelined the national interests. Just try to ascertain the performance gains that were obtained since the 2005 Public sector collective agreement. You, citizen out there, do you believe the Public sector is giving you better service than 7 years back?
