Tobacco adverts ‘at close proximity’ to be banned by 1 January, 2011
A new legal notice is to ban the advertising of tobacco products “at close proximity” by 1 January 2011.
The law effectively sets a deadline for the removal of existing adverts displayed at close proximity, that is not more than 1 metre from the point of sale of tobacco products and which are not visible from the outside of the retail outlet.
It also bans the use of lotteries and other gift schemes for the promotion and advertising of any cigarettes, tobacco and tobacco products.
Regulation 5 on the sale of tobacco from automatic vending machine stipulates that no person may sell or permit to be sold any other product except cigarettes and tobacco products from automatic sales machines which are used to dispense cigarettes and tobacco products.
Cigarette decoys shall only be allowed on premises from which tobacco products are sold provided that such decoys carry the health warning: “Smoking kills."
