Hit and run driver wins 'moral damages'

A driver who stands charged with the hit and run incident of twin sisters in Attard last April, was this morning awarded €1,000 in compensation from a court that ruled that his fundamental rights were breached.

Mr. Justice Joseph Micallef ruled that the Magistrates court breached Max Ciantar’s human rights when it granted him bail but ordered him to stay at Mount Carmel Hospital.

Ciantar, who was represented by lawyer Joe Brincat, stressed that once he was ordered to pay €3,000 in bail and guarantee another €20,000 as a personal guarantee, his confinement to Mount Carmel Hospital was not justified.

The court that heard the submissions, ordered the Attorney General’s office to pay Max Ciantar €1,000 in moral damages.

Who gives a damn about his 'fundamental rights'? What about the 'fundamental rights' of two little girls to be able to cross the road safely?

Why was he sent to Mount Carmel in the first place?
