Minister Helena Dalli reiterated the Government’s will to strengthen the Office for Competition, within the Malta Competition and Consumer Affairs Authority (MCCAA).

The office ensures the effective application of the law for the benefit of consumers and economic operators.

“This is necessary in order to ensure that it can effectively perform its tasks and where necessary strengthen the legal regime affecting it and the laws it applies,” Dalli said while addressing a seminar on competition law.

Helena Dalli said that competition is the driving force of a market economy and that this mechanism instigates undertakings to offer goods and services at the most competitive, and therefore favourable, terms and conditions to the consumer.

“Competition encourages companies and all economic operators to be efficient and to come up with more innovative products and services.  For the individual consumer, competition ensures lower prices, better quality and wider choice. For the economy as a whole, competition boosts and supports economic growth,” she said.

Dalli also spoke about enforcement of competition law, which if done efficiently, protects competition and safeguards both the economy and consumer welfare.

Offences under the MCCAA are Criminal Offences. Article 39(1) of the Constitution of Malta states 'Whenever a person is charged with a criminal offence he shall, unless the charge be withdrawn, be afforded a fair hearing within a reasonable time by an independent and impartial court established by law'. The MCCAA is not 'an independent and impartial court established by law'. This an an unconstitutional body set up by a previous Administration. Mrs Minister, you are being set up by your enemies. Wake up and smell the coffee.

Its no use ! Competition does not, and is unable to exist in our small island. Not only that but we are allowing SOLE agencies to represent foreign companies, which are against EU regulations, and part of the medicine shortages issue. We also have local export manufacturers and importers of the same product. All efforts are futile.
