Evicted from home by Family Court, angered man attempts to demolish house

A 48 year-old man was remanded in custody and will spend Easter in prison under preventative arrest, after he was charged with trying to demolish his matrimonial home, from which he was evicted during separation proceedings.

Joseph Axisa, 48 of Mosta was arrested on Monday evening after he was pulled out of the cabin of his crane as he swung the jib to demolish the house.

Axisa’s estranged wife and his 18 year-old daughter were in the house at the time, and it took some time for the police to calm the man’s rage, who had been served by the Family Court with the eviction notice.

According to defence counsel Emmy Bezzina, his client was angered at the fact that he tried to enter his matrimonial home after a long day’s work, only to find that the door locks had been changed.

The police charged the man with causing serious damage to the house, resisting arrest, threatening his wife and daughter and reckless driving.

His brother Paul Axisa, who was called to the scene and got involved in the argument and was also arrested, pleaded not guilty to the charges of attempting to seriously injure his niece and slightly injuring her, resisting police and threats.

Magistrate Marseann Farrugia ruled the arrest legal and agreed to the appointment of a psychiatrist to examine the state of mind of the accused.
