Couple ask courts to stop judicial sale of ship

A Maltese couple have filed a Constitutional Case and asked the First Hall of the Civil Court to stop the judicial sale by auction of a ship they own and that was seized by customs.

Paul and Alexandra Piscopo have claimed that their fundamental human rights were violated through the forced sale of their ship.

The Piscopo’s filed their case against the Prime Minister, the Attorney General and the Controller of Customs.

In their writ, Paul and Alexandra Piscopo said that that although Paul Piscopo was facing criminal charges on customs violations, these have not yet been concluded.

They accused the Controller of Customs of seizing the Piscopo’s ship "Alexandra 1" and started procedures for its sale by judicial auction.

In their action, the Piscopo’s stressed that if the ship was sold, the they would suffer irremediable damages and would lose their livelihood without any compensation.

They added that the provisions of the Customs Ordinance enabling the forced sale of the ship was in violation of their fundamental human rights.
