Teachers compensated after 'unfair' termination of kindergarten employment
Three teachers at Garendon school in Zebbug, all members of Malta Union of Teachers, have had their contracts terminated on the basis of 'business closing down' with a tribunal years later ordering their compensation
Three members of the Malta Union of Teachers (MUT) and former kindergarten teachers at the Garendon School in Zebbug were granted a €6,000 compensation each after the industrial tribunal declared the termination of their teaching contracts "unjust."
The MUT said in a statement that they were satisfied with the decision of the tribunal.
The plaintiffs had been employed by Garendon School in Zebbug for many years before it ceased operations in 2014. The three teachers, all members of the MUT, had been informed that their employment would be terminated as the school was closing down and had even been paid the salaries they were due up till the beginning of the 2013/2014 scholastic year based on a Civil Court decision in 2017.
The tribunal decided that from the resulting proof, it would not say that the termination of their employment was justified, especially since the school continued to run its kindergarten, and that it was therefore "unfair."
Garendon School was represented by lawyer Andrew Borg Cardona.
The teachers were represented by lawyer Michael Tanti Dougall.
